Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Heath Foundry LLC, a California limited liability company doing business as Sunrise Labs ("Sunrise Labs," "we," "us"), governing your use of the Messages for AI application, Texting Wrapped, the messagesfor.ai and textingwrapped.com websites, checkout pages, update and remote-configuration services, and related software (together, the "Service"). By installing, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What the Service is

Messages for AI is a local macOS application that connects an AI assistant (such as Claude or Codex) to your iMessage and WhatsApp context on your own Mac. It reads message context locally, stages drafts, and sends messages only through a review-and-approval flow ("AI proposes, you approve"). Core message data stays on your Mac as described in the Privacy Policy. Texting Wrapped and related Labs turn local message metadata and selected local analysis into playful summaries, dashboards, or story cards.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. The Service is not directed to and may not be used by children under 13, and you must not connect accounts, contacts, or message data of children under 13 in a way that causes us to process their personal information. If you let others use your device, you are responsible for their use of the Service.

3. Your responsibility for messages and the law

You are solely responsible for every message sent through the Service, including messages drafted by the AI. The Service stages drafts for your review; you decide whether and what to send. Review drafts before sending.

You represent and warrant that you have the legal right to access, read, and process the messages, conversations, and contacts you connect to the Service, and that your use complies with all laws that apply to you. This includes laws governing the interception, recording, monitoring, or processing of electronic communications, which in some U.S. states and other countries require the consent of all parties to a communication. You are responsible for determining and meeting any consent or notice obligations to the other people in your conversations. The Service is a tool; we do not provide legal advice and do not determine whether your use is lawful in your situation.

4. Other people's data

The Service processes information about people you communicate with who are not users of the Service, such as contact names, phone numbers, and message content. You are responsible for having a lawful basis to process that information and for honoring the rights those people may have under applicable data-protection law. Do not use the Service to process other people's personal information for purposes they would not reasonably expect.

5. WhatsApp and the unofficial client (please read)

WhatsApp support connects through Baileys, an unofficial, community-maintained WhatsApp Web client. It is not an official WhatsApp product or API, and using the Service with WhatsApp may violate WhatsApp's Terms of Service. Linking your WhatsApp account carries a real risk that WhatsApp flags, restricts, or bans your number, which for many people is their primary phone number. We cannot prevent this and it is outside our control. You link WhatsApp at your own risk, and to the maximum extent permitted by law we are not liable for any suspension, restriction, ban, or loss of access to your WhatsApp account or number. You can use the Service with iMessage only and never connect WhatsApp.

6. AI providers and your API keys

Certain optional features ("Labs") can send selected message excerpts, aggregate fingerprints, or sanitized hints to a third-party AI provider (such as Anthropic or OpenAI) using an API key that you supply. Your use of those providers is governed by the provider's own terms and privacy policy, and you are responsible for your provider account and key. We are not responsible for how a provider processes content you choose to send.

7. Payments and tips

Tips are optional payments to Sunrise Labs. They are not charitable donations, do not buy a service-level agreement, and do not guarantee feature work, support priority, or continued availability. Payments are handled by Stripe; Sunrise Labs does not see or store your card details.

8. Updates, security controls, and the remote kill switch

To protect users, we may publish a signed control message that the app verifies and honors, which can require a minimum supported version or temporarily disable sending or specific features in response to a security issue or a third-party service problem. You agree that the Service may fetch this signed control message and apply it, and that we may require you to update to continue using all features. We are not obligated to provide updates or to keep any feature available.

The Messages for AI source code is released under its open-source license (see the repository), which governs your rights in the source code. These Terms govern your use of the Service and the binaries, website, and update and configuration service we provide. Where the two conflict regarding the source code, the open-source license controls for the source code.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, that AI-drafted content will be accurate or appropriate, or that messages will be delivered. AI output can be wrong or misleading; you are responsible for reviewing it.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNRISE LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, MESSAGES, ACCOUNTS (INCLUDING WHATSAPP OR MESSAGING-ACCOUNT BANS), GOODWILL, OR PROFITS, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE PRIOR 12 MONTHS OR (B) US $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You will indemnify and hold harmless Sunrise Labs from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your messages, your processing of other people's information, or your violation of these Terms or any law.

14. Termination

You may stop using the Service at any time and remove the app and its local data. We may suspend or stop providing the Service, in whole or in part, at any time. Sections that by their nature should survive termination (including sections 3, 4, 11, 12, 13, and 15) survive.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute that is not otherwise resolved, except where applicable law gives you a non-waivable right to bring a claim elsewhere.

16. Changes to these Terms

We may update these Terms. When we make material changes, we will update the version and effective date and, where the app records your acceptance, ask you to accept the updated Terms before continuing. Your continued use after an update means you accept the updated Terms.
